Sabotaged by Bank of America part 2
Ok, so here we go again. It is 3 days before my home goes up for auction. I got a call from Bank of America on Wednesday the 12 of January and spoke to someone in the collections department. I vented my frustration. They had the audacity to tell me something could have been done, but as of now it is too late. They said that the account should have been escalated and been fixed of the problem of misappropriation of funds into the wrong account. She also said that the funds could have been transfered from my escrow account into my principle and interest payment. I am calling BS on what she said. So what she is telling me after speaking with I would say at least 50 different people about my account that all of a sudden something could have been done. Also, I requested twice to have the funds transfered from my escrow account to my principle payment. Nothing ever happened. So, after speaking with my attorney. I have no other option to save my house other than filing bankruptcy and buying some time. I have no problem paying my debt, but forced into bankruptcy to have a fighting chance to save my home. I am, to say the least, beyond frustrated with Bank of America. If you have Bank of America I am sorry. If you don't, you are a wise person. If anyone has had any luck with B of A let me know what works. Please and Thank you!

Sabotaged by Bank of America
Ok, so I am writing this a week and a half before my home goes up for auction. I am writing this because I am frustrated beyond belief with Bank of America, I know I am not the only one in this predictament. I lost my job last year and ended up doing a modification. We started making payments again in November of 2009. Our trial period for our modification was February through the beginning of May. We kept making our payment without missing a single month from November of 2009 through August of 2010. When we called to make our payment for September, Bank of America would not take it because we were back into foreclosure. The month after our modification was finalized, we got the notice of intent to accelerate. Let me repeat that, the month after our modification went through we got our notice of intent to accelerate. Apparently by September we were 3 to 4 months behind, although I had not missed a payment since November of 2009. I immediately called them and they said not to worry about it, that the monies had been applied to a different account. They would fix the problem. I kept in touch with them (I have 12+ pages of notes and hours and hours on the phone.) I have spoken to every department many times over with no avail. So needless to say I had to hire an attorney to save my home. I have heard many people speaking about their frustration with Bank of America. But until this happened I didn't listen to them. I hope this helps get the word out there, and also if any of you have any ideas as to saving my house let me know.
